On June 8, 2011, the BC Supreme Court granted Sun Wave Forest Products Ltd.'s request to delay its two court actions against the City.
In January and February 2010, Sun Wave filed two court actions against the City, claiming ownership of Watson Island and the buildings and equipment on the island.
In March 2011, the City set down separate trials in both cases for June 15 and 16, and June 22 and 23, 2011. The City was unable to set the trials to be heard together because Sun Wave's two sets of lawyers were not available at the same time.
On June 7, 2011, Sun Wave applied to adjourn the trials so that the two actions could be heard together at the same trial. The court granted Sun Wave's request and ordered that the trials be heard together before the end of October 2011. The trials have now been set for October 31, 2011.
Mayor Jack Mussallem stated "We are disappointed that the cases have been delayed. The people of Prince Rupert deserve some closure and we hoped to achieve that by setting down the trials. However, we have a court order setting a firm date now, so there should be no further delays. We look forward to bringing an end to the litigation. In the meantime, we will continue to try to reduce our costs, and to work in a positive and constructive manner towards a successful outcome for Watson Island."
